These terms apply to every loan advanced by Motshelo with Attie.
These terms govern the use of this website and any loan advanced by Motshelo with Attie. They are read together with the Acknowledgement of Debt and Undertaking to Pay that every borrower signs before funds are released.
Completing the application form on this website does not create a loan and does not oblige us to lend. Every application is subject to verification of your identity, employment and income, and to an affordability assessment. We may decline an application without giving reasons.
You must give true, complete and current information. Providing false information, a false payslip or a document that is not yours entitles us to decline the application, cancel any loan already advanced and claim immediate repayment of the full outstanding balance.
Interest is charged at 30% per month on the capital amount advanced. Interest accrues for every month, or part of a month, that the capital remains outstanding. The total repayable is set out in the Acknowledgement of Debt before you sign it.
Repayment is due on the dates set out in the Acknowledgement of Debt. Payment must be made in Botswana Pula into the account nominated by the lender, and is only treated as received once it reflects in that account. You remain liable for the full balance until it is paid.
If any instalment is not paid on its due date, the full outstanding balance becomes immediately due and payable without further notice. Interest continues to run on the outstanding capital until the debt is settled in full.
If recovery steps become necessary, you are liable for the legal costs of that recovery on the attorney and own client scale, together with collection commission and tracing costs.
Before funds are advanced you sign an Acknowledgement of Debt and Undertaking to Pay. In that document you admit liability for the capital and finance charges, choose an address for the service of legal documents (domicilium citandi et executandi), and renounce the ordinary legal exceptions, including non causa debiti, errore calculi, no value received and de duobus vel pluribus reis debendi.
You must notify us in writing if your address, employer, email address or cellphone number changes while a loan is outstanding. Notices sent to the last details you gave us are treated as validly delivered.
By applying you agree that we may contact you by email, cellphone call and text message about your application, your loan and amounts that are due.
You may settle the loan early. Interest is calculated up to and including the month in which full settlement is received.
The information on this website, including any repayment estimate, is provided for general guidance. The figures in the signed Acknowledgement of Debt prevail over any figure shown on this website.
These terms and every loan are governed by the law of the Republic of Botswana, and the parties consent to the jurisdiction of the Magistrates Court in respect of any dispute arising from them.
